Variation of Conditions (incl. Undertaking)[edit]

This is an example variation of conditions to permit an accused to be in contact with an alleged victim.

The alleged victim should be put on the stand by defence counsel and the following should be covered:

  • biographical information of V (age, employment, education, etc.)
  • relationship with accused
  • whether V knows about the charges against D
  • whether V knows about the conditions on D
  • whether V knows why the conditions exist
  • whether V wants the terms to change
  • whether V is voluntarily testifying and no one is pressuring them
  • whether V fears D
  • whether V is aware that the police can be of assistance
