affadavit
burden of leading evidence
burden of proof
character evidence
evidence that establishes a witnesses standing in the community, reputation, and history of past actions.
circumstantial evidence
evidence that proves a fact, though not directly at issue, is sufficient that it may infer, from the circumstances, the existance of a fact that is at issue.
direct evidence
evidence that proves a fact at issue. a first-hand account of an incident. (cf. circumstantial and heresay evidence.)
documentary evidence
evidence in written or printed form.
heresay evidence
indirect evidence
irrebuttable presumption
judicial notice
oral evidence
statements made under oath or solemn affirmation by a witness during a trial.
permissive presumption
probative value
the degree to which a type of evidence contributes to the proof of a proposition.
real evidence: evidence in the form of physical objects
